GardenBook contains stuff from us, you, and other users. You agree not to copy, modify, or distribute GardenBook, our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (We need these rights to host and display your content.) If you believe that your rights have been violated, please notify our designated copyright agent at GardenBook Customer Support and we will investigate the matter. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party's rights.

When you register with our site you will be asked to provide an email address, your first and last name, your phone number, and address. Optionally you may also choose to opt into our newsletter. This information is used to create a unique profile for you on our site. You can choose to add your phone number so that buyers can contact you by phone. Your home address is used to send you mail related to products, feature sheets, and for sale signs.
When you visit our web site, we collect information about your visit (e.g. session length, pages visited, network location) based on the IP address of your computer, or your unique user identifier (if you are a registered user). Our web site uses cookies and access logs to facilitate this tracking. This information is used to analyze how people use our web site. It is also used to save your favorites or saved listings.
In the case of third party web sites like Facebook, and Twitter - we do not collect any information and simply forward you to their web sites. Please review their privacy policies.
When you advertise on our website, we collect information that includes your email address, your first and last name, your job title, company name, company description, an url link, an image that includes either a company logo, profile image, or related business photo.
This information is used to provide an advertisement.

When you list a property on our web site we collect information about its location, condition, features and your asking price. This information is used to help you attract potential buyers to your listing. During the listing process you will also be asked to provide contact information which will be publicly disclosed so that buyers may contact you.
We use the address from the listing to facilitate easy finding of your property using Google maps. We can also use the location information for photography services.
GardenBook utilizes a number of internal and third party methods to recognize visitor data such as IP addresses and browser settings.
You agree that the Terms will continue to apply until terminated by you by notifying GardenBook, or by closing your accounts where we made the option available to you. Notice should be sent to us in writing at info@gardenbook.ca. We may terminate our relationship with you if you breached, or unable to comply with the Terms, required to do so by law, or we are no longer providing the service
GardenBook's internal servers and software automatically records data when you visit the website. No personal information is revealed in this process. GardenBook may use such data to compile traffic data about the kind and types of visitors that use the website at specific intervals.
From time to time, GardenBook may use the standard Cookie feature of major browser applications and third party providers as well as employ internally developed cookies and tracking code which allows GardenBook to store a small piece of data on a visitor's computer about the visit to the GardenBook website. Personal information is not captured in such cookies, nor does GardenBook use cookies to mine Personal information. Personal information is only captured when a visitor signs in to the system and willingly discloses such information.
GardenBook may maintain links to other websites. If you choose to visit other websites, we are not responsible for the Privacy Practices or content of those other websites, and it is your responsibility to review the Privacy Policies at those websites to confirm that you understand and agree with their policies.
You may choose not to provide us with any Personal information. In this case, you may be able to visit the website, browse listings; however, you will not be able to access and use those portions of the website which require your Personal information.
If you do not wish to receive information and/or promotional materials from GardenBook or from our partners, you may select the appropriate 'opt-out' at the time you create your account or may unsubscribe from our mailing list on any one of the promotions or other materials we send to you.
GardenBook will keep your Personal Information private, and will not share it with third parties unless to fulfill your order, such as for payment, or if GardenBook is required by law to comply with a valid legal requirement such as law, federal regulation, search warrant, subpoena or court order.
The Site may include links to third party websites. Please note that any Personal Information disclosed in such areas is public and becomes public information. You should use caution when deciding to disclose your personal information.
We maintain a procedure to help you confirm that your Personal Information remains correct and up-to-date. Through your personal account profile, you are able to (i) review and update your Personal Information, (ii) modify your listing.
Upon your written request, subject to certain exceptions, GardenBook will inform you of the existence, use and disclosure of your Personal Information and will give you access to that information. Access requests should be sent to our Privacy Coordinator, using the contact information below.
To help protect the confidentiality of your Personal Information, GardenBook employs administrative and technological safeguards appropriate to the sensitivity of your Personal Information. Where Personal Information is sent to a third party for processing we ensure, through our contacts with them that all Personal Information is kept secure. We operate secure data networks protected by industry standard firewall and password protection systems.
We strive to make certain that you're Personal Information and our listing management service is stored in secure locations in Canada and on servers that incorporate the encryption and security devices. To prevent unauthorized access, we have implemented physical, electronic, and managerial procedures to safeguard and secure the information we collect. Your personal information is transmitted to us by secure servers. Your sign in, payment and listing information is secured using GeoTrust 256 bit encryption.
GardenBook currently retains Personal Information for a period of seven years.
GardenBook has security measures in place to prevent the loss, misuse, destruction and alteration of the information that you provide us or we obtain from you. We will have no liability however to you or to any third party arising out of any such loss, misuse, destruction, or alternation.
GardenBook reserves the right to modify or supplement this Privacy Policy at any time. If we make a change to this Privacy Policy, we will post such changes on our website and make such revised policy and changes available upon request to the GardenBook Privacy Coordinator. However, GardenBook will obtain the necessary consents required under applicable privacy laws if it seeks to collect, use or disclose your Personal Information for purposes other than those to which consent has been obtained unless otherwise required or permitted by law.
